These Terms & Conditions ("Terms") are a legal agreement between you and Elaaf Digital Innovations (Commercial Registration No. 197903-1), Kingdom of Bahrain ("Trainica", "we", "us", "our"), governing your access to and use of the Trainica website at www.trainica.ai, our applications, and related services (together, the "Platform"). By creating an account, or by buying, creating, or listing a course, you confirm that you have read, understood, and agree to be bound by these Terms and by the policies referenced in them (the Refund Policy, Privacy Policy, and Marketplace Policy). If you do not agree, do not use the Platform.
The Platform is operated by Elaaf Digital Innovations, an individual establishment registered in the Kingdom of Bahrain under Commercial Registration No. 197903-1, whose registered office and contact details appear at the end of this document. Trainica is an online marketplace where users generate, publish, buy, and study AI-assisted educational courses.
To use the Platform you must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a legally binding contract. You must provide accurate, current, and complete information and keep it up to date. You are responsible for all activity under your account and for keeping your sign-in credentials secure. One person or entity may not maintain multiple accounts to abuse promotions, evade suspension, or manipulate the marketplace. We may refuse, suspend, or terminate accounts that breach these Terms.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Platform for its intended purpose. You may not copy, scrape, resell, sublicense, reverse-engineer, or create derivative works from the Platform or its content except as expressly permitted.
Courses on the Platform are produced with artificial-intelligence tools (including third-party AI models) based on prompts provided by Creators. AI-generated content may contain errors, omissions, or outdated information, and is provided for general educational purposes only. It is not professional, legal, medical, financial, or other regulated advice, and must not be relied upon as such. Creators are responsible for reviewing and validating the accuracy of their Courses before listing, and Learners should exercise their own judgement.
If you create or list Courses, you represent and warrant that you own or have all necessary rights to the topics, materials, and prompts you submit, and that your Courses do not infringe any third-party rights or violate any law or our Marketplace Policy.
Trainica provides the technology and marketplace through which Creators can generate, publish, market, and sell access to Courses. Except where we expressly state otherwise, Creators are independent users of the Platform and are not employees, agents, partners, franchisees, or representatives of Elaaf Digital Innovations. Creators have no authority to bind Trainica or make commitments on our behalf. Trainica may act as the marketplace operator and payment facilitator for transactions processed through the Platform. The checkout, receipt, and applicable tax documentation will identify the relevant transaction details. Nothing in these Terms changes any responsibility that applicable consumer, tax, payment, or other law places directly on Trainica or on a Creator.
When you enrol in or purchase a Course, we grant you a personal, non-exclusive, non-transferable licence to access that Course for your own learning, subject to these Terms. Unless a Course or offer expressly states a fixed access period, we aim to provide continuing access while the Platform operates and we have the legal and technical right to make the Course available. "Lifetime", "permanent", or similar wording, if used, refers to the commercial availability of the relevant Course or Platform service and does not guarantee that the Platform, a particular feature, or third-party service will operate indefinitely. You may not share, resell, publicly broadcast, or redistribute Course content, or use it to build a competing product. Certificates are issued on completion and a passing score and evidence your completion only; they are not accredited qualifications unless expressly stated.
Unless the checkout page expressly states otherwise, prices are displayed and charged in Bahraini Dinar (BHD). The Platform computes the authoritative price at checkout; you agree to pay the price shown. Payments are processed by our third-party payment provider (MyFatoorah), supporting cards, BenefitPay, KNET, and Apple Pay. Access or entitlements are granted only after payment is verified. Prices, fees, and platform settings may change from time to time; changes do not affect purchases already completed. You are responsible for any taxes applicable to you; where value-added tax (VAT) or similar taxes apply, they will be handled in accordance with Bahraini law.
Subscription plans grant the benefits described at purchase (such as additional free-course enrolments and discounts on a set number of paid courses), frozen for the plan period. Where auto-renewal is offered and you opt in, you authorise us and our payment provider to charge your payment method automatically at the start of each period until you cancel. You may cancel at any time; cancellation stops future renewals but does not entitle you to a refund of the current period, and you keep any remaining benefits until it expires. For each qualifying sale, the Platform retains a commission and the Creator earns the remainder, calculated under the rules published on the Platform and recorded in an append-only ledger. Applicable fees may include the production fee, optional add-on fees (such as AI Q&A), and a bank fee deducted at payout. Earnings accrue to the Creator's balance and may be withdrawn once they reach the minimum payout threshold, subject to completed profile and bank details and to our review. We may withhold, reverse, or adjust earnings in cases of refund, chargeback, fraud, or policy violation. Long-dormant balances may be handled in accordance with the Platform's dormancy rules.
We may offer referral rewards and promotional credits subject to their specific terms. Rewards are void where obtained through self-referral, fake accounts, or other abuse, and may be revoked. We may change or end any promotion at any time.
The Platform, including its software, design, brand, and the "Trainica" name and logo, is owned by or licensed to Elaaf Digital Innovations and protected by intellectual-property laws. Except for the licences expressly granted here, no rights are transferred. If you believe content on the Platform infringes your rights, contact us with sufficient detail and we will review and, where appropriate, remove it. Any feedback or suggestions you provide may be used by us without obligation to you.
We may review, moderate, restrict, remove, or unlist Content, and restrict, suspend, or terminate accounts where reasonably necessary to enforce these Terms or our policies, comply with law or a lawful request, prevent fraud or security harm, or protect Users, third parties, and the Platform. We may use automated systems to flag or temporarily restrict content or accounts, but material enforcement decisions may be reviewed under the Marketplace Policy appeal process where appropriate. Repeated or serious policy violations may result in suspension or termination. You may stop using the Platform at any time. Termination ends your right to use the Platform, but provisions that by their nature should survive — including intellectual-property licences needed for previously enrolled Learners, payment and ledger obligations, disclaimers, limitations of liability, indemnity, and dispute provisions — continue as applicable. Learner access to previously purchased Courses is handled as described in Section 7 and subject to applicable law.
The Platform relies on third-party services (for example, payment processing, cloud hosting, email delivery, AI generation, text-to-speech, and phone verification). Your use of certain features may be subject to those providers' terms. We are not responsible for third-party services beyond our reasonable control.
The Platform and all Content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including as to accuracy, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law. We do not warrant that the Platform will be uninterrupted, error-free, or that AI-generated Content is accurate or complete.
To the maximum extent permitted by applicable law, Elaaf Digital Innovations and its owner, employees, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or opportunity, arising out of or relating to the Platform, even if the possibility of such loss was known. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Platform will not exceed the greater of (a) the amount you paid directly to Trainica in the three (3) months immediately preceding the event giving rise to the claim or (b) BHD 50. These exclusions and caps do not apply to liability that cannot lawfully be excluded or limited, and they do not limit any non-waivable consumer right or mandatory remedy available under applicable law.
If you use the Platform as a Creator or for business purposes, you agree, to the extent permitted by law, to indemnify and hold harmless Elaaf Digital Innovations and its owner, employees, and partners from third-party claims, damages, losses, liabilities, and reasonable costs (including reasonable legal fees) arising from (a) Content or materials you submit or publish, (b) your infringement of a third party's rights, or (c) your material breach of these Terms or applicable law. This indemnity does not apply to the extent a claim results from Trainica's own unlawful conduct or breach of these Terms.
These Terms are governed by the laws of the Kingdom of Bahrain. You and we will first try to resolve any dispute amicably by contacting us. If a dispute cannot be resolved, it will be subject to the exclusive jurisdiction of the competent courts of the Kingdom of Bahrain, without prejudice to any mandatory consumer-protection rights you may have.
We may update these Terms from time to time. We will post the updated version here with a new effective date and, for material changes, take reasonable steps to notify you. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
If any provision of these Terms is held unenforceable, the remaining provisions continue in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them to a successor. These Terms, together with the policies referenced in them, are the entire agreement between you and us regarding the Platform. Notices to us should be sent to the contact details below.
